Legal Aspects of Private Car Sales in Switzerland
When selling a car privately in Switzerland, there are several legal points you should be aware of:
Purchase contract: While a written contract is not legally mandatory, it is strongly recommended. It protects both parties and documents the condition of the vehicle at handover. The TCS offers a well-established purchase contract template. The contract should include: personal details of both parties, vehicle data (make, model, chassis number, mileage), known defects, purchase price, and a warranty exclusion.
Warranty: According to the Swiss Code of Obligations (CO) Art. 197β210, the seller is liable for assured properties and deliberately concealed defects. In private sales, the warranty can be excluded in the purchase contract (CO Art. 199) β this is strongly recommended.
MOT (Motorfahrzeugkontrolle/vehicle inspection): A valid MOT is not a requirement for sale, but it significantly increases the vehicle value and buyer confidence. Vehicles without a valid MOT must be inspected by the buyer before being put into service.
Vehicle deregistration: After the sale, you must deregister the vehicle at the cantonal road traffic office and return the licence plates. Deadlines vary by canton.
Insurance: The licence plate insurance (liability) ends automatically upon deregistration. Any comprehensive insurance must be cancelled separately.

- Test drive: Copy the ID and driving licence before every test drive. Ideally, ride along.
- Foreign buyers: Exercise particular caution with enquiries from abroad β frequently fraud attempts with forged payment receipts.
- Suspicious signals: Too-quick agreement without a viewing, overpayment with a refund request, middleman constructions.
- Handover protocol: Document the vehicle condition at handover in writing and have it signed by both parties.
- Check cash payment: Have larger amounts checked for authenticity at the bank counter.
